These were my first new style soft-shell 'waterproof' pants bought about 10 years ago, I quickly realised they are not fully waterproof, but are water resistant enough for the alps etc. I also don't think they also don't have sealed seams or anything like that so the water does get in when it rains.
they're not really intended for scottish style winter days so do serve their purpose if you accept they are not fully waterproof.
You could probably nikwax wash them to get more waterproofness back as well.
So no, you haven't been sold a pup.
